These Terms of Service (“Terms”) form a legally binding agreement between you (“you” or “your”) and Mergeflo Inc. (“Mergeflo,” “we,” “us,” or “our”) governing your access to and use of our websites (including www.mergeflo.com), applications, APIs, and other services linked to these Terms (collectively, the “Service”). By accessing or using the Service, you accept these Terms. If you do not agree, do not use the Service.
The following policies are expressly incorporated:
Mergeflo provides an AI-driven platform for:
“User Content” means any text, content, or data you upload, create, or generate using the Service.
“Licensed Content” refers to any Mergeflo-provided tools, templates, or assets.
You must be at least 13 years old (or the minimum digital-consent age in your region) and legally able to form a binding contract.
If registering with an email controlled by your organization (employer, school, or other entity), you represent that you have authority to bind that entity.
Teams group multiple users under one subscription. The creator is the Team Owner. Team Owners or Admins may manage seats, assign permissions, and access User Content.
Each user must maintain a unique login. You are responsible for all activity under your credentials.
Upgrade to a paid plan for privacy and commercial rights.
Mergeflo grants a limited, revocable, non-exclusive, non-transferable license to access and use the Service according to your subscription.
You must comply with the following:
Violation may result in suspension or termination.
You retain rights to your content. Mergeflo is granted a worldwide, royalty-free license to operate, improve, and promote the Service.
Use governed by Content License Agreement; some assets may have additional restrictions.
Content generated via AI tools is considered User Content. Similar outputs may be generated for other users.
Feedback or suggestions you provide are irrevocably assigned to Mergeflo.
Mergeflo’s AI-generated outputs (“Algorithmic Outputs”) are produced using automated processes and may contain inaccuracies, errors, or unintended content. Mergeflo makes no warranties or guarantees regarding the accuracy, reliability, or suitability of such outputs. Users and customers are solely responsible for reviewing, validating, and applying human oversight, quality assurance, and editorial judgment before relying on or publishing any Algorithmic Output. Mergeflo shall not be liable for any losses or damages arising from the use or reliance on such outputs.
You may share content internally or externally. Paid plan content remains private unless explicitly published.
Integration with third-party apps, platforms, or APIs is for convenience. Use is governed by their terms; Mergeflo disclaims liability.
The Service is provided “as is” and “as available.” Mergeflo disclaims all warranties to the maximum extent allowed by law.
The disclaimers in Section 6.5 regarding Algorithmic Outputs also apply (see Section 6.5).
Mergeflo’s total liability does not exceed USD $100 or the amount paid in the previous 12 months, whichever is higher. No liability for indirect, special, incidental, or punitive damages.
You agree to defend and indemnify Mergeflo and affiliates from claims arising from your content, violation of these Terms, or breach of law.
You are responsible for ensuring AI-generated content does not infringe on third-party rights. Mergeflo disclaims liability for such claims.
Terms governed by State of Delaware, USA. Disputes resolved via individual arbitration; class-action waivers apply.
Users must comply with all applicable laws; prohibited regions or end-users are restricted.
Material changes take effect 30 days after notice via email or in-product. Continued use indicates acceptance.
